Terms governing our Website Jumpstart rapid WordPress development service.

1. Introduction
This Website Jumpstart Terms and Conditions Agreement (the "Agreement") is entered into by and between Ryan Davis LLC, doing business as WebOps Hosting ("WebOps," "we," "us," or "our") and the customer ("Customer," "you," or "your").
This Agreement is supplemental to our General Terms & Conditions, Acceptable Use Policy, and Privacy Policy. By ordering the Website Jumpstart service, you acknowledge that you have read, understood, and agree to be bound by these terms.
2. Definitions

WordPress
The open-source content management system (CMS) utilized as the foundation for your website.

Theme
A pre-designed template that determines the overall look, feel, and style of your WordPress website.

Template Kit
A collection of pre-designed page templates that work together to create a cohesive website design.

Core Plugins
The essential plugins required to enable the functionality of the chosen theme or template kit.

Design Layout
The visual arrangement of elements, text, and media on a web page.
3. Scope of Service
The Website Jumpstart service is designed to accelerate your website development. We will build your foundation from a chosen theme demo, template kit, or design layout.
This service includes the installation of WordPress, setup of core plugins, and configuration to match the demonstration layout. The result is a solid foundation for you to build upon.
Please note: This service does not include custom design work, content creation, or extensive modifications beyond the initial configuration.
4. Eligibility
To be eligible for the Website Jumpstart service, you must have an active Managed WordPress Hosting plan with WebOps Hosting.
5. Service Process
The Service Process involves the following standard steps:
- The Customer chooses a theme or template from our approved library or provides a compatible third-party option.
- WebOps installs WordPress, configures the necessary core plugins, and imports/matches the chosen demo layout.
- The Customer provides their own content, or professional placeholder content will be utilized for layout structure.
- Following the completion of the jumpstart, the Customer is entirely responsible for reviewing and further customizing their website content and imagery.
6. Limitations
The Website Jumpstart service is strictly subject to the following limitations:
- No custom design services or graphic design are provided.
- No content creation (such as copywriting, image sourcing, or branding) is included.
- No extensive modifications will be made beyond the initial setup of the chosen layout.
- The service applies to exactly one (1) theme or template per service order.
- WebOps is not responsible for any inherent theme or plugin incompatibilities caused by third-party developers.
"Extensive modifications" are defined as including, but not limited to: creating custom structural layouts, building custom backend functionality, extensive CSS/styling modifications, writing custom JavaScript, creation of custom post types or taxonomies, and building third-party API integrations.
7. Intellectual Property
All Customer-provided content remains the Customer's sole and exclusive property.
Premium themes, templates, and plugins provided by WebOps during the service are licensed directly to WebOps and subsequently sublicensed to the Customer. We grant you a limited, non-transferable sublicense to use these components strictly within the context of your WebOps-hosted website.
You may not extract, reproduce, resell, or distribute these individual components outside of the provided hosting environment under any circumstances.
8. Customer Responsibilities
The Customer agrees to provide accurate configuration information when requested, remain reasonably available for review during the jumpstart setup process, and handle all subsequent customizations, text replacements, and content population after the initial setup is deemed complete by WebOps.
9. Disclaimer of Warranties
The Website Jumpstart service is provided on an "as-is" and "as-available" basis. WebOps makes no express or implied warranties regarding the service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Limitation of Liability
In no event shall WebOps be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or related to this service, including loss of data or loss of revenue. Our total aggregate liability shall be strictly capped at the total amount paid by the Customer for the specific Website Jumpstart service order.
11. Changes to Terms
We reserve the right to modify these terms and conditions at any time without prior direct notice. Changes will be posted to this page with an updated "Last Updated" date. Your continued use of the service or resulting website following any such changes constitutes your acceptance of the new terms.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
