Effective Date: November 9, 2025. This document outlines the specific terms governing the use of WebOps Hosting's Managed Email services. Please read these terms carefully before utilizing our email infrastructure.
1. Introduction
These terms govern the provision and use of Managed Email Hosting services provided by Ryan Davis LLC, operating as WebOps Hosting ("WebOps," "we," "us," or "our"). Our email services are designed strictly for business-to-business communications. These terms operate as a supplemental agreement to our General Terms & Conditions, Acceptable Use Policy, and Privacy Policy. By ordering, provisioning, or utilizing our Managed Email Hosting Addon, you signify your explicit acceptance of these terms.
2. Scope of Service
WebOps Hosting provides robust, traditional IMAP and POP3 mailboxes tailored for professional business-to-business (B2B) communications. Our scope of service focuses on delivering highly reliable transactional and individual correspondence capabilities, backed by enterprise-grade security features and deliverability monitoring.
3. Email Hosting Features
Our Managed Email Hosting includes fully featured IMAP/POP3 mailboxes accessible across all standard email clients. The service is managed via the Plesk control panel and is fortified with robust security protocols, spam filtering, and active monitoring and alerting systems specifically designed to maintain high sender reputation and global deliverability.
4. Default Email Configuration
To ensure optimal server performance and protect the IP reputation of our hosting environment, email hosting is disabled by default on all Managed WordPress plans. Accounts are initially configured to utilize Sendmail strictly for necessary website-generated notifications (e.g., password resets, form submissions).
To utilize full email functionality, customers must actively enable the Managed Email Hosting Addon. This addon is provided free of charge, but all email data storage will utilize your existing hosting plan's storage quota.
5. Spam Policy
Zero-Tolerance Spam Policy: WebOps Hosting maintains a strict, zero-tolerance policy against spam. Sending unsolicited bulk email will result in the immediate disabling of your email service without prior notice or warning.
Our infrastructure must not be used to send unverified, unsolicited, or bulk emails of any kind. Please refer directly to our Acceptable Use Policy for comprehensive details regarding our definition of spam and the enforcement of this policy.
6. Prohibited Use
Our Managed Email Hosting environment is meticulously tuned for individual, professional correspondence. As such, using our mail servers for marketing emails, promotional blasts, mass announcements, or newsletters is strictly forbidden.
Customers requiring bulk mailing capabilities must utilize dedicated third-party services (such as Mailchimp, SendGrid, or Constant Contact). Non-compliance with this prohibition will result in the immediate suspension of your email service to protect the deliverability rates of other tenants. 7. Customer Responsibilities
As a user of our Managed Email Hosting, you agree to the following responsibilities:
- 7.1 Compliance: You must comply entirely with the CAN-SPAM Act, relevant local data protection laws (such as GDPR or CCPA where applicable), and industry-standard email best practices.
- 7.2 Security: You are strictly responsible for maintaining strong, secure passwords for all provisioned mailboxes, actively monitoring your account activity, and notifying WebOps Hosting immediately of any suspected security breaches, compromised accounts, or unauthorized access.
8. Monitoring and Security
To protect our network integrity and ensure the reliability of services for all clients, we implement the following measures:
- 8.1 Rate Limiting: Outgoing email limitations and rate limits are actively enforced via the Plesk control panel to prevent automated abuse or the fallout from compromised mailboxes.
- 8.2 Deliverability Monitoring: We implement comprehensive postfix monitoring and queue analysis to ensure near-perfect global deliverability for all legitimate business communications originating from our servers.
9. Suspension and Termination
We take the reputation of our mail servers seriously to benefit all clients:
- 9.1 Immediate Suspension: We reserve the absolute right to immediately suspend email services for any violation of these terms, especially concerning spam, phishing, or abuse.
- 9.2 Termination: We may permanently terminate email services without notice for severe, intentional, or repeated violations of these terms or our Acceptable Use Policy.
10. Limitation of Liability
To the maximum extent permitted by applicable law, WebOps Hosting shall not be held liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, missed communications, or loss of business resulting from the use, delay, or inability to use our email services.
11. Changes to Terms
We reserve the right to modify these terms at any time to reflect changes in our services, technology, or legal requirements. Significant or material changes will be communicated directly to active customers via their registered administrative email address. Continued use of the email service following any published changes constitutes your explicit acceptance of the revised terms.
12. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.
