Outlines the terms governing the use of our Cloud VPS WordPress Hosting services.

Effective Date: November 21, 2025. Please read these terms carefully before utilizing WebOps Hosting's Cloud VPS WordPress services.

1. Introduction

This Agreement is entered into between Ryan Davis LLC (trading as WebOps Hosting) and the customer ("You" or "Customer"). These Terms and Conditions govern your use of our Cloud VPS WordPress Hosting services. This document is supplemental to and incorporates by reference our General Terms & Conditions, Acceptable Use Policy (AUP), and Privacy Policy.

By ordering and utilizing our Cloud VPS services, you explicitly signify your acceptance of these Terms and Conditions in their entirety.

2. Service Description

WebOps Hosting provides virtual private servers (VPS) that are specifically architected and optimized for WordPress environments. Our Cloud VPS services include dedicated system resources, full root access (upon request or depending on the plan), scalable performance capabilities, and customizable server configurations tailored to high-demand WordPress applications.

3. Account Setup and Configuration

Upon order confirmation and payment processing, WebOps Hosting will provision your Cloud VPS with the agreed-upon resources. While WebOps Hosting provides the infrastructure and may offer initial setup assistance or server migrations, the Customer retains primary responsibility for configuring, maintaining, and managing their WordPress installation, including themes, plugins, and core application updates.

Managed Services Distinction: Ongoing application-level management is solely the Customer's responsibility unless a specific Managed VPS Support plan has been purchased in addition to the standard hosting services.

4. Resource Allocation and Scalability

Each Cloud VPS plan is allocated specific quotas for CPU cores, RAM, storage space, and monthly bandwidth. Customers may scale their server resources up or down subject to hardware availability and billing adjustments.

WebOps Hosting actively monitors infrastructure usage to ensure network stability. In instances where a Customer's resource utilization continuously exceeds their plan limits or negatively impacts the broader infrastructure, WebOps Hosting reserves the right to recommend mandatory upgrades or temporarily throttle resources to protect network integrity.

5. Security and Compliance

WebOps Hosting implements comprehensive network-level security measures, including hardware firewalls, intrusion detection systems, and routine security audits of the host nodes.

However, server-level and application-level security remains a shared responsibility. The Customer is responsible for:

  • Applying operating system security patches (unless fully managed).
  • Maintaining up-to-date WordPress core, themes, and plugins.
  • Enforcing strong password policies and access controls.
  • Conducting routine malware scanning and remediation within their VPS environment.

Failure to maintain a secure environment that results in network abuse, outbound spam, or participating in DDoS attacks may result in immediate account suspension or termination without refund.

6. Backups and Data Protection

WebOps Hosting offers optional, premium backup services which may include full server image snapshots and granular WordPress site backups. The Customer is responsible for ensuring these backup services are properly configured and monitored.

Important Backup Notice: Unless a specific backup service is purchased and actively maintained, WebOps Hosting provides no guarantee of data retention or recovery capabilities. We strongly encourage all customers to maintain their own independent, off-site backups of critical data.

7. Service Availability

WebOps Hosting targets high availability for all Cloud VPS infrastructure. Our service uptime commitments and applicable credits for failing to meet these targets are detailed comprehensively in our Service Level Agreement (SLA), which is incorporated herein by reference.

8. Technical Support

Technical support for infrastructure, network connectivity, and hardware failure is provided via our ticketing system, email, and live chat. For standard unmanaged or semi-managed Cloud VPS plans, support is strictly limited to ensuring the server is online, accessible via SSH/RDP, and that the underlying network is functioning normally.

Application-specific support, including WordPress troubleshooting, plugin conflicts, and custom server configurations, falls entirely outside the scope of standard support unless a managed plan is actively subscribed to.

9. Billing and Payment

Cloud VPS services are billed in advance according to your selected billing cycle (e.g., monthly, annually). Payment is due on the generated invoice date. WebOps Hosting reserves the right to adjust pricing structures with a minimum of thirty (30) days advance written notice.

Failure to remit payment within the grace period may result in automated suspension of the VPS instances, followed by permanent termination and data destruction.

10. Termination

Either party may terminate this agreement by providing thirty (30) days written notice. WebOps Hosting reserves the right to terminate services immediately and without notice in the event of a material breach of these Terms, the AUP, or for non-payment.

Upon termination, all access to the VPS will be permanently disabled. Customer data will be irretrievably deleted after the termination date. If the Customer hosts third-party clients on their VPS, it is their sole responsibility to notify their clients and arrange for necessary data migrations prior to termination.

11. Limitation of Liability

To the maximum extent permitted by applicable law, WebOps Hosting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from your use of the Cloud VPS services.

In no event shall WebOps Hosting's total liability for all claims related to the services exceed the total amount of service fees paid by the Customer in the twelve (12) months immediately preceding the event giving rise to the liability.

12. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding arising under this Agreement will be brought exclusively in the federal or state courts located in Delaware, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

13. Amendments

WebOps Hosting reserves the right to update, modify, or replace these Terms and Conditions at any time. The most current version will be posted on our website with an updated "Effective Date." Your continued use of the Cloud VPS services following any changes constitutes your acceptance of the revised terms.
